In accordance with Article 13 of the GDPR and Article 11 of the LOPDGDD, this Privacy Policy applies to the processing of personal data that TISELAB, S.L. (hereinafter, TISELAB) carries out as the data controller, in relation to the data that users and/or customers (natural persons) provide as a result of the request for information and/or contracting of the services and/or products that it provides and markets through this website, or collected in any of the sections of this page.

PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data will be used for the generic purpose of managing and controlling the commercial relationship established between the user and the data controller, and specifically for:

  • To manage full access to and correct use of services and/or products by users.
  • To communicate with users in response to incidents, requests, comments and questions you make to us through the contact forms on our website (including emails and/or telephone calls).
  • To provide, update, maintain, and protect the services and/or products offered
  • To offer new services and/or products, special offers or updates.
  • Where appropriate, to manage personnel selection processes in selection processes for workers and/or collaborators.

We will not process your personal data for any purpose other than those described above, unless it is imposed by law or there is a judicial and/or administrative requirement that involves data processing for purposes other than those set out.

 

RETENTION PERIOD

The personal data provided will be kept and processed for as long as the contractual relationship with the user is maintained, without prejudice to the possibility of exercising their rights in terms of data protection. The data may also be kept for the time necessary to comply with legal obligations applicable to the data controller.

 

The personal data of persons interested in receiving commercial information and newsletters will be kept indefinitely as long as the interested party does not request their opposition to the sending of commercial communications or deletion of their data. 

 

LEGITIMACY OF THE PROCESSING

TISELAB processes your personal data in accordance with the following legal bases: Consent of the data subject (1), the performance of a contract or pre-contractual measures (2) and legitimate interest (3). 

  1. The consent of the interested party given for the purposes described above, which shall be requested: 
  • Before proceeding to process your data,
  • In the process of registering/hiring as a customer or,
  • At the time of sending TISELAB commercial communications.

Requests for information that you send us require you to voluntarily provide us with the necessary data to be able to respond to the requests. However, you can freely refuse to provide us with this data or, subsequently, revoke the consent previously granted to process your data. In these cases, the refusal to provide personal data will make it impossible to respond to the requests of the users, and the revocation of the consent given will not affect the processing based on the consent of the interested party carried out before it was revoked.

  1. The processing of data by TISELAB is necessary for the performance of a contract to which the data subject is a party or for the application of pre-contractual measures at the request of the data subject. This legal basis will apply if the user purchases products or contracts services through our website.
  2. TISELAB‘s legitimate interest in maintaining and retaining its customers and/or users and better meeting their previously expressed expectations or interests, for example: improving the products and/or services offered, managing requests, queries or complaints, offering products similar to those contracted, informing about current promotions and discounts, among others. All of the above shall be without prejudice to TISELAB’s compliance with the rest of the obligations relating to the sending of commercial communications by electronic means regulated by Law 34/2002, of 11 July, on information society services and electronic commerce.

TISELAB understands that, by providing us with their personal data, the interested party guarantees and is responsible for the veracity, timeliness and accuracy of the same, and that they expressly accept and consent to their processing for the purposes described above. If the user provides data of other people, he/she affirms that he/she has their permission and undertakes to share with them the details of this Privacy Policy, releasing TISELAB from any liability in this regard. This can be verified by carrying out the necessary actions and taking the appropriate precautions according to current law.

 

RESUMES

Purpose: TISELAB makes available to interested parties a contact form/email address/online platform where they can send their CVs in order to involve the interested party in the personnel selection processes and thus analyse the applicant’s profile with the aim of selecting a candidate(s) for the vacant position or positions of the person in charge. The CVs received through these channels will be deleted in the event that there is no vacancy or there is no active selection process, informing the interested party of this circumstance. If a CV has been received, even if there is no active selection process and once the CV has been received and read by TISELAB, it intends to keep it because it shows interest in the candidate’s profile, the candidate will be informed of this circumstance, respecting, in any case, the retention periods defined in this section. These may also be incorporated into the database.

Legitimation: The legal basis for the processing of personal data contained in CVs is based on the execution of a contract to which the data subject is a party or for the application at the request of the data subject of pre-contractual measures (Article 6.1.b GDPR) or by the consent of the data subject (Article 6.1.a GDPR)

Duration and retention: The data will be kept for the duration of the selection process and, in any case, for a maximum period of 6 months.

International data transfers and/or transfers: Data will be transferred to third parties who have access to personal data processed by the data controller in order to comply with the legal obligations applicable to the controller (public authorities) and/or contractual obligations (collaborators with whom the corresponding data processor contracts have been signed). Under no circumstances will international data transfers be carried out except in the cases contemplated in the international transfers section of this Privacy Policy.

Rights: Candidates may exercise their rights of access, rectification, deletion, opposition, limitation and portability with respect to their personal data in the manner established in this Privacy Policy.

 

RECIPIENTS OF INTERNATIONAL ASSIGNMENTS OR TRANSFERS.

In general, TISELAB will not transfer your personal data to third parties unless we are legally obliged to do so or you have expressly authorised us to do so when using our services and/or products.

TISELAB will not carry out international transfers of personal data collected through this website, with the exception of the following cases:

  • That the international transfer of data is necessary for the performance of a contract or pre-contractual measures to which the data subject is a party.
  • That the international transfer of data is necessary by application of current legislation.
  • That the international transfer of data takes place with the express consent of the interested party.
  • That the international transfer of data takes place because the website is hosted on servers located outside the European Economic Area.

In any case, in the cases in which international data transfers may take place, TISELAB will verify that the country importing the data guarantees an adequate level of protection in application of the regulations in force.

 

RIGHTS OF INTERESTED PERSONS.

Data protection regulations allow you to exercise your rights of access, rectification, opposition, deletion (“right to be forgotten”), limitation of processing, portability and not to be subject to individualised decisions before the data controller. Below, we explain what these rights consist of:

  • Right of access: It allows the interested party to know and obtain information about their personal data subject to processing.
  • Right to rectification: Allows you to correct errors, modify data that are inaccurate or incomplete and guarantee the accuracy of your personal data.
  • Right to erasure: Allows you to request the deletion of your personal data when they are no longer necessary for the execution or provision of the service.
  • Right of opposition: It allows the interested party to not carry out the processing of their personal data or request their cessation, except for legitimate reasons or for the exercise or defence of possible claims, in which case we will keep them blocked for the corresponding period.
  • Right to object to the sending of advertising: Interested parties may oppose the sending of commercial communications. In this case, you can revoke your consent to receive these notifications at any time. 
  • Limitation of processing: In certain circumstances, data subjects may request the limitation of the processing of their data, in which case they will only be kept for the exercise or defence of claims.
  • Data portability: Data subjects may request to receive the data concerning them that they have provided to us or that – whenever technically possible – we send them to another data controller of their choice, in a structured format that is commonly used and machine-readable.
  • Right not to be subject to automated individual decisions (including profiling): Data subjects have the right not to be subject to a decision based on automated processing that produces legal effects or significantly affects the data subject.
  • Possibility of withdrawing consent: The data subject has the right to withdraw the consent given at any time when it consists of the legal basis for the processing of personal data, without this affecting the lawfulness of the processing based on the consent given at the time of providing us with their data.

We may ask you for additional information in order to verify your identity.

Possibility of filing a complaint with the Supervisory Authority: TISELAB also informs you of your right to file a complaint with the Spanish Data Protection Agency (www.agpd.es) if you consider that the processing carried out does not comply with current regulations.

 

ADDITIONAL INFORMATION

Minor

TISELAB recommends the use of this website to people over 18 years of age. If minors under 14 years of age access it, the consent of the minor’s parents, guardians or legal representatives will be necessary in order to process their personal data. The parents, guardians or legal representatives of the minor will be solely responsible for the content that the minor may have access to when visiting our website. 

Social Media

It is possible that TISELAB has profiles on the different social networks. It is also possible that the user can access the private spaces that may exist on this website through their accounts on social networks, instead of accessing with a username and password. In these cases, users who provide their personal data with the information available through their account and/or user profile on social networks are informed that this is responsible for the data processing that is carried out, unless other conditions are expressly informed in a specific processing.

Retention of certain data

TISELAB informs that, in compliance with the provisions of Law 25/2007, of 18 October, on the conservation of data relating to electronic communications and public communications networks, it must retain and store certain traffic data generated during the development of communications in order to transfer them to the legitimate authorities.  when the legal circumstances provided for therein are met.

Recorded data

Our servers collect information automatically when you use the services of the websites. This log data may include IP address, identification of the device from which our website is accessed, the operating system used, and device settings, among others.
